Detailed Instruction for Notification of Premature Termination of Employment Contracts of Foreign Domestic Helpers

Please read the following notes before you start the notification:

1. Important Notice
(a) According to Clause 12 of the Standard Employment Contract for a foreign domestic helper (ID407), in the event of termination of the contract, both the employer and the helper shall give the Director of Immigration notice in writing within 7 days of the date of termination.
(b) A foreign domestic helper is permitted to remain in Hong Kong for 2 weeks from the date of termination of the employment contract or the remainder of permitted period of stay, whichever is earlier.
(c) Either the employer or the foreign domestic helper can use this online service to notify the Immigration Department of such termination.
(d) The notification message will be transmitted to the Immigration Department for updating of the immigration status of the foreign domestic helper.
(e) A person who knowingly and wilfully makes a statement or gives information which he knows to be false or does not believe to be true shall be guilty of an offence under the law.
2. Online Notification
(a) In making the notification online, it is essential to quote the relevant visa reference number of the Immigration Department and state the exact date of termination.
(b) You may also furnish to the Immigration Department online with other supporting documents, such as a copy of the written notice of termination.

3. Purpose of Collection
The personal data provided in this notification will be used by the Immigration Department for one or more of the following purposes:
(a) to process your notification;
(b) to administer/enforce relevant provisions of the Immigration Ordinance (Chapter 115) and Immigration Service Ordinance (Chapter 331), and to assist in the enforcement of any other Ordinances and Regulations by other government bureaux and departments through carrying out immigration control duties;
(c) in connection with any other person's applications for immigration facilities in which you are named as a sponsor or referee;
(d) for research and statistical purposes; and
(e) any other legitimate purposes.
The provision of personal data for the processing of your notification is voluntary. If you do not provide sufficient information, we may not be able to process your notification.

4. Classes of Transferees
The personal data you provide may be disclosed to government bureaux, departments and other organizations for the purposes mentioned above.

5. Access to Personal Data
You have a right to request access to and correction of your personal data as provided in sections 18 and 22 and Principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance (Cap 486). Your right of access includes the right to obtain a copy of your personal data provided in this notification subject to payment of a fee.
